Menjalica — Terms of Use

1. Acceptance of these Terms

By creating an account or otherwise using Menjalica ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Service. You must be at least 13 years old to use Menjalica. If you are under 18, you confirm you have permission from a parent or legal guardian.

2. About the Service

Menjalica is a peer-to-peer platform that helps users discover, propose, and coordinate the physical exchange of collectible stickers — typically from albums published by Panini, Topps, and similar publishers. Menjalica facilitates the matchmaking, the messaging, and the record of agreed trades. We do not buy, sell, ship, value, authenticate, or escrow any stickers or other goods. Every exchange happens directly between users.

3. Your account

You are responsible for the accuracy of the information you provide, for keeping your password and any linked sign-in methods (Google, Apple, Facebook) secure, and for every action taken under your account.

Tell us at [email protected] if you suspect unauthorised access. You may close your account at any time from Profile → Settings → Delete account. Deletion removes your personal data; your username and the public history of completed swaps and reviews stay visible because other users rely on that history as a trust signal.

4. Acceptable use

You agree not to: send spam, harassment, threats, hate speech, or any content that is illegal in your country or in Serbia; misrepresent yourself, impersonate someone else, or operate multiple accounts to inflate ratings; knowingly propose or accept a swap you do not intend to honour; ship anything other than the agreed stickers in the agreed condition; disclose another user's personal data outside the context of an accepted swap; or probe, scrape, or disrupt the Service.

Violations are handled through the report system (kebab menu on the user's profile) and may lead to a warning, account suspension, or a permanent ban.

5. Trades between users

A swap proposal becomes a binding promise between the two users only after both have accepted the proposal in the app. Until acceptance, either side may cancel without consequence.

After acceptance, both sides are expected to ship promptly and confirm receipt honestly. Menjalica is not a party to the trade. We do not guarantee that the other user will ship, that the package will arrive, or that the contents will match the agreement.

If a trade goes wrong, your recourse is: (1) communicate with the other user, (2) cancel the swap, (3) leave a thumbs-down review, (4) submit a report against the user.

6. User content and reviews

When you write a review, send a chat message, or upload an avatar, you grant Menjalica a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content inside the Service. You retain ownership.

Reviews are blind: yours becomes visible to the other party only after they have submitted theirs (or after the fixed reveal window). Reviews must be factual, relevant to the specific swap, and free of personal attacks or unrelated information.

7. Intellectual property

Sticker numbers, names, and reference imagery in the catalogue are properties of their respective publishers (Panini Group S.p.A., The Topps Company, Inc., and others). Menjalica reproduces the minimum needed (number, label, optionally a small image) to identify which physical sticker is being referenced — descriptive, non-commercial use that does not imply endorsement, sponsorship, or affiliation.

If you are a publisher and believe your rights are misused, write to [email protected] and we will respond promptly. The Menjalica name, logo, and software are owned by UX Platz DOO; do not copy or republish them without permission.

8. Service availability

We provide the Service on an "as is" and "as available" basis. We do our best to keep it running but make no promise of uninterrupted access. We may pause, modify, or discontinue any part of the Service at any time. Where reasonably practical, we will give advance notice of significant changes.

9. Limitation of liability

To the fullest extent permitted by law, Menjalica is not liable for: loss, damage, or non-delivery of stickers exchanged between users; indirect, incidental, or consequential damages; loss of profits, data, or goodwill; or any matter beyond our reasonable control (force majeure, network outages, third-party failures).

Where liability cannot be excluded, it is limited to the amount you have paid Menjalica in the twelve months prior to the claim (typically zero, as the Service is currently free).

10. Termination by us

We may suspend or terminate your account if you breach these Terms, if law enforcement requires it, or if continued operation puts other users at risk. We will normally tell you why. In severe cases (fraud, abuse, illegal content) we may act without prior notice.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the app and, where possible, by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the law of the Republic of Serbia. Disputes that cannot be resolved between us informally will be brought before the competent courts of Belgrade. If you are a consumer in the European Union, mandatory consumer-protection rules of your home jurisdiction still apply.
